Agricultural Operation Declaration

The Fox & Crow Farm

948 Province Road

Barnstead, New Hampshire

Date: November 20, 2025

The Fox & Crow Farm respectfully submits this declaration to clearly document and confirm that the activities occurring on this property are agricultural in nature and protected under existing New Hampshire law, including RSA 21:34-a, RSA 674:32-a through 32-c, and the New Hampshire Right-to-Farm statute.

This declaration is not submitted as a request for permission, but as a clarification of use consistent with state law and long-standing agricultural practice.

Lawful Agricultural Activities on This Property

The Fox & Crow Farm engages in a diversified agricultural operation that includes:

Livestock & Animal Husbandry

  • The raising, breeding, care, and management of livestock including horses, poultry, rabbits, and other farm animals.

Cultivation & Horticulture

  • The growing, harvesting, and storage of crops including vegetables, herbs, greenhouse products, and forage crops.

Agricultural Product Development

(in accordance with RSA 21:34-a II & III)

  • The processing, preservation, packaging, and sale of agricultural goods produced on the farm.

Education, Training & Farm-Based Experiences

  • Workshops, demonstrations, apprenticeships, and instructional activities relevant to agriculture, land stewardship, animal care, and rural trades.

Agritourism (RSA 21:34-a III-b)

  • Farm-based visitation including:

tours, workshops, farm dinners, and overnight accommodations for farm guests and participants of farm-related activities.

Land Stewardship & Timber Use

  • Timber harvesting and use of wood resources from the property for fencing, structures, and farm infrastructure.

  • Soil improvement, grazing management, manure management, wildlife considerations, and conservation-based practices.

Structures & Agricultural Use

All barns, sheds, outbuildings, and accessory structures on the property may be used for:

  • animal care,

  • agricultural storage,

  • product development,

  • education,

  • agritourism activities,

  • or other uses clearly protected under RSA 21:34-a.

These uses are accessory to the farm and fall within the normal range of activities associated with an operating agricultural property.

Legal Status & Protections

Under RSA 21:34-a, agriculture—and its natural evolution into agritourism, education, and value-added production—is recognized as a lawful use, distinct from commercial zoning designations.

RSA 674:32-b and 32-c protect agricultural operations from unreasonable or prohibitive local regulation that would interfere with normal agricultural activity.

New Hampshire’s Right-to-Farm statute (RSA 432:32-35) affirms that established agricultural operations may continue without being subject to unnecessary complaint, harassment, or selective restriction.

Statement of Intent

The Fox & Crow Farm will continue to operate as a working agricultural property, with activities that may expand or adapt over time as is customary and necessary for modern sustainable farming.

These activities fall squarely within state law and accepted agricultural practice.

Signed,

Erin Stone and Jared Hanselman
